Barter system part of appeal for Brussels art show (Reuters)

BRUSSELS (Reuters) ? In the history of currency, earplugs have, unsurprisingly, never been widely used or accepted. So when a man offered Belgian artist Delphine Bo?l 10,000 earplugs for her print "The Source of Identity" at the Truc Troc contemporary art exhibit in 2006, her reaction was, "God, he's crazy."

Then she thought about it overnight - and became inspired.

"I phoned the guy the next day and I said, 'You've got the print, give me 10,000 earplugs and I'm going to make a work of art with it.'"

Unusual offers are the norm and part of the fun of Truc Troc, which is in its eighth year since restarting in 2004 after initial shows in 1975 and 1976.

The event's concept came from Belgian sculptor Mon de Rijck, who wanted to "democratize" art exhibitions through bartering.

Visitors to Truc Troc post an offer near a piece of art and the artist can choose which offer, if any, they want to accept.

Event organizers said on Sunday afternoon they were on pace for about 20,000 visitors, the same as last year, for the three-day event at Bozar, a Brussels fine arts centre.

The exhibition, which included a party with DJs on Friday night, was meant to attract young people and remove barriers to the traditionally expensive art world.

"Maybe some people come just to listen to the DJ or to drink some beer," said Mikhail Porollo, a photographer participating in the show. "But then at the end of the day, they walk through the exhibition, they know what's happening ... and then they interact with the art."

Most of the artists taking part are also young, just starting their careers and looking for exposure. The exhibition spanned a wide variety of media such as traditional acrylic paintings or photography to more avant-garde materials such as cardboard or metal street signs.

About 100 artists contributed 300 pieces for the exhibition.

PRIVATE THOUGHT

Before Christmas, Delphine Bo?l, 43, completed a couple of prints with the each letter in the word "hypocrite" in a variety of bright colors.

In her living room, there is one version with a white background, "Endless Hypocrites," that says there is not just one hypocrite, but many. Bo?l showed "Private Thought" at this year's Truc Troc, with a black background and a slight twist.

In the centre of "Private Thought," Bo?l put a crooked gold crown on one of the Os - a nod to King Albert II of Belgium.

Bo?l has said she is the illegitimate daughter of Albert and her claim has been widely reported in the media. The palace has declined to comment.

Many of Bo?l's pieces are layered over this background.

"From my experience, I am going to build, and from that I am going to exhibit it and from that I am going to sell it," she said of translating her feelings into art.

"Private Thought" received more than 100 offers at Truc Troc, putting it among the more popular pieces at the event.

Porollo, 33, chronicled multiculturalism in his photography project, "Goddesses," from May 2010 to May 2011. He took portraits of 12 women in Brussels, all of whom were from different countries. He chose four photos for his first appearance at Truc Troc.

Porollo covered each woman in traditional clothing associated with their homeland, so only their faces are visible. He said the choice had little to do with religion and is meant to create a blank background and highlight their faces.

He edited each picture, of women from Europe, Africa, Asia and South America to make their faces perfectly symmetrical - a scientific ideal of beauty.

The photographer and painter, who comes from the northern Caucasus in Russia came away from Truc Troc pleased: the 250 pamphlets he had printed were gone by Sunday afternoon.

Belgian artist Jerome Considerant deconstructed three famous paintings as metal street signs, with two of his inspirations coming from the Royal Museum of Fine Arts in Brussels.

The "Tower of Babel" by Pieter Bruegel the Elder is imagined as an orange and black construction sign with the partly finished tower rising above busy workers. Considerant also simplified Jacques-Louis David's "Death of Marat" down to a few basic shapes, yet both works remain recognizable.

He also re-examines Theodore Gericault's "The Raft of the Medusa," which depicts the aftermath of a shipwreck whose survivors on a raft endured cannibalism and madness.

Colbert reports Super PAC now worth over $1M

Last night on "The Daily Show," host Jon Stewart broke down the ongoing verbal brawl between GOP presidential hopefuls Mitt Romney and Newt Gingrich, otherwise known as Floridal Kombat. Much like the video game it was named for, each debate zing scored the candidates points against each other, and -- as polls suggest -- it was Romney who prevailed with a K.O. ??

And then, stuff hit the fan.

"The Colbert Report's" Stephen Colbert finally found Jon Stewart on the set of his show (of all places), and demanded the Super PAC money be set free. After a Liam-Neeson-in-"Taken" inspired monologue, a high-speed chase on foot?ensued.?Running around?the "Daily Show" offices, Colbert and Stewart participated in cartoon-like antics -- complete with stunts, horse-drawn carriages,?and somehow they wound up making a cameo on "The View."

Colbert managed to corner Stewart in a dead end for the "transfer" of PAC energy. A situation that can only be described as a Spider-Man-Upside-Down-Kiss-meets-Harry Potter-Dementor's-Kiss came next ... and then green flames shot out of him and the building around him.

Finally, the Super PAC hostage crisis comes to an end!

The thing is, it is a most valuable Super PAC to be in control of -- no wonder Stewart was reluctant to give it up. According to The Hollywood Reporter, that Super PAC has now crossed the million-dollar mark and as of Jan. 30, was worth $1,023,121.24.

The number comes from a letter sent to the Federal Election Commission on Monday from Shauna Polk, treasurer of the Super PAC, more formally known as Americans for a Better Tomorrow, Tomorrow. Colbert (President of the PAC), asked her to quote him as saying "'Yeah! How you like me now, F.E.C.? I'm rolling seven digits deep! I got 99 problems but a non-connected independent-expenditure only committee ain't one!"

Polk distanced herself from that quote, writing, "I would like it noted for the record that I advised Mr. Colbert against including that quote."

Colbert posted a statement on his (newly-returned) Super PAC's website, saying, "Colbert Super PAC has brought in a staggering $1,023,121.24, which my accountant explains to me that is a number far above 'one,' 'two,' 'five,' or even 'many.' We raised it on my show and used it to materially influence the elections -- in full accordance with the law. It's the way our founding fathers would have wanted it, if they had founded corporations instead of just a country."

That's a hard act to follow, but "Jimmy Kimmel Live!" host did his best, acknowledging the fact that it was Bubble Wrap Appreciation Day. After that, he moved on to his favorite target -- Herman Cain. First,?Kimmel?suggested that Cain's endorsement of Newt Gingrich was his way of thanking the former House Speaker for all of the pizzas he'd ordered over the years.

Then,?he focused on the "sausage grinder" analogy Cain made during the endorsement speech to describe how grueling the campaign trail can be. It's safe to say that "sausage" and "grinder" are two words Mr. Cain should drop from his vocabulary, Kimmel joked.

Finally, Jimmy introduced us to this gem. It's a Newt Gingrich-inspired rap song called "Hoot for Newt" that was reportedly played at his Jan. 28 rally in Port St. Lucie, Fla. rally. The Huffington Post reached out to Gingrich press secretary R.C. Hammond to try and find out who wrote and performed the song, but was told "No clue."

Yes, that exists. Perhaps it'll become the national anthem when we all occupy the moon.

Fly Delta Android app updated to ease international travel

Fly Delta Android App

Delta Air Lines' Fly Delta Android app has long been one of the first things I install on a phone. It's well-designed, and has added a couple killer features since its release nearly a year ago -- mainly the ability to view upgrade/standby lists and check and change seats from your phone, and more recently they added the ability to track your checked baggage. Good stuff.

And now Delta's added even more functionality in Version 1.7. Here's the full changelog.

  • Check in for flights arriving or departing international locations
  • Discover Delta’s valued partners within the "Traveling with Us" section
  • Support for Android 4.0 (Ice Cream Sandwhich) [sic]
  • Fixes for many of the bugs reported by our customers, along with several speed enhancements

It's nice that Delta's added check-ins for international flights. (Though you'll presumably still have to get your boarding pass when you arrive.) The "Traveling with Us" section is a little bit of advertising (we've got a screen cap after the break), where so far we have promotion of Delta's American Express credit card and something from TED. It's pretty unobtrusive, though, so no big deal. Then there's the ICS support and other bug fixes, which is always good (though the app had been working just fine for us), though there's still a menu button down at the bottom, and not as an Action Bar "overflow" as Google's pushing everyone toward. (On the other hand, the app's design is otherwise very nice, so we'll overlook that.)

But what really gets us excited is the prospect of "several speed enhancements." With previous versions of the app, you needed to fire it up a few minutes before you could get to your itinerary and find your confirmation number or seat assignment or mobile boarding pass. Things definitely feel a little quicker; hopefully that's not just a placebo -- it really was a big gripe with the Delta app.

Facebook takes on 'clickjacking' spammers in court (Reuters)

SEATTLE (Reuters) ? Facebook and the state of Washington sued a company on Thursday they accused of a practice called "clickjacking" that fools users of the world's top social network into visiting advertising sites, divulging personal information and spreading the scam to friends.

The scheme, also known as "likejacking" because victims are tricked into using Facebook's "Like" button to perpetuate it, has grossed $1.2 million a month for the Delaware-based firm, Adscend Media, according to the state attorney general's office.

Adscend profits from the scam by collecting money from its advertising clients for every Facebook user unwittingly misdirected to a target ad or subscription service, the plaintiffs said.

Two separate but similar claims filed in federal court by the state and Facebook accuse Adscend of violating federal and state statutes outlawing misleading or deceptive commercial electronic communications and unfair business practices.

The legal action is believed to mark the first time any state government has gone to court in a crackdown against spam spread by Facebook, the world's most widely used social media network, said Paula Selis, senior counsel for the attorney general.

She said schemes such as clickjacking have grown steadily more pervasive, and that millions of Facebook users have probably been exposed to Adscend's spam.

"Security is an arms race," Ted Ullyot, Facebook's general counsel, told a news conference at the California-based company's Seattle office to announce the lawsuits. "It's important to stay a step ahead against spammers and scammers."

Attorney General Rob McKenna, a Republican running for governor, said Washington state was taking action because "we've brought other cases like this and, more than any other state, we've developed technological and legal expertise" in the field of cyber fraud.

Representatives of Adscend or two co-owners also named as defendants could not immediately be reached for comment.

PAGES DESIGNED AS BAIT

As described in the lawsuits, the scam works as follows:

Facebook pages designed as "bait" are disseminated to social network users as posts that seemingly originate from friends, offering visitors an opportunity to view salacious or provocative content.

However, that viewing is contingent on completing a series of steps that will supposedly unlock the content but are actually designed to lure Facebook users onto other sites, where they are tricked into giving away personal information or signing up for expensive mobile subscription services.

First the victims are encouraged to click the "Like" button on the Facebook "bait" page, which then alerts their friends to the page's existence, thus helping propagate it. Then they are told they cannot reach the content without filling out a form for an online survey or advertising offer.

In one example cited, the "Like" button is overlayed with a link labeled: "This man took a picture of his face every day for 8 years!" The promised content often does not exist, and the user instead is directed through a series of prompts taking them off Facebook and to a string of ads and subscription offers.

In some cases, a hidden code embedded in an enticing link on the "bait" page activates the "Like" button without the user even clicking it, sending it to friends' news feeds.

Selis said it may seem unlikely that anyone would click on such links, "but unfortunately they do."

While the number of Facebook users actually scammed by clickjacking is not known, Selis said investigators have determined that some 280,000 users visited the locked content pages of Adscend during February 2011 alone.

"So we know there are probably millions of Facebook users" exposed to the deception, she said.

Facebook spokesman Andrew Noyes said the Adscend action was the latest in "our pursuit and support for civil and criminal consequences for spammers or others who attempt to harm Facebook or the people who use our service."

He cited three federal court judgments worth several hundred million dollars each obtained by Facebook against spammers since 2008.

Gingrich promises US moon colony by 2020

Republican presidential candidate Newt Gingrich said on Florida's space coast that if he is elected president he will create a moon colony by 2020.

COCOA, Fla. -- Newt Gingrich promised Wednesday on Florida?s space coast to create a moon colony by 2020 if elected president.

"By the end of my second term, we will have the first permanent base on the moon. And it will be American," Gingrich told the crowd of roughly 700, taking them to their feet in applause.

The former House speaker said the current space program in the country is a "tragedy" and believes his "grandiose" ideas can help fix it.

"I am sick of being told we have to be timid and I'm sick of being told we have to be limited to technologies that are 50 years old," he said, noting that by 2020 he wants to be capable to go to Mars.

Former Massachusetts Gov. Mitt Romney seemed to question Gingrich?s desire to put lunar mining colonies on the moon during a debate last month but the speaker says these are bold ideas the governor doesn?t understand.

"I was attacked the other night for being grandiose. I would just want you to note: Lincoln standing at Council Bluffs was grandiose. The Wright Brothers standing at Kitty Hawk were grandiose. John F. Kennedy was grandiose. I accept the charge that I am grandiose and that Americans are instinctively grandiose," Gingrich said.

Speaking about space is not new for Gingrich. In stump speeches, he often references his ideas to change the struggling American program,?but this was the first event he?completely dedicated to the topic, hoping this is "the second great launch of the adventure John F. Kennedy started."

"At one point early in my career I introduced the northwest ordinance for space and I said when we got -- I think the number is 13,000 -- when we have 13,000 Americans living on the moon they can petition to become a state," Gingrich said, telling the crowd this was the "weirdest" thing he has ever done. "And I will as president encourage the introduction of the northwest ordinance for space to put a marker down that we want Americans to think boldly about the future?"

Gingrich finished off his public schedule for the day with a Space Industry Roundtable at Brevard Community College.

Four-year-old boy pulls out marijuana at school snack time (Reuters)

(Reuters) ? A pre-kindergarten boy who announced to his teacher at snack time that he wanted to share pulled nine bags of marijuana out of his jacket pocket, police said on Wednesday.

Police in Meriden, Connecticut, some 20 miles south of Hartford, were called to Hanover Elementary School Tuesday afternoon after the 4-year-old special needs student displayed the drugs, authorities said.

Meriden police said the nine individually wrapped bags of marijuana appeared prepared for sale.

Hanover Elementary School principal Miguel Cardona called it an "extremely unfortunate" and "isolated" incident that was not witnessed by any other students.

"What's so disheartening is this is really an adult issue and problem and adult behavior put a student at risk," Meriden schools superintendent Mark Benigni told Reuters.

"This student had no idea what he brought to school or what the substance was," he added.

Authorities are not releasing the names of the student or parents and police said there is a possibility for arrests pending the outcome of the investigation.

The Department of Children and Families is also looking into the incident.

EU court denies Viaguara trademark (AP)

BRUSSELS ? A European Union high court ruled on Wednesday that the name Viaguara cannot be registered as an EU trademark for energy and alcoholic drinks because it is too similar to the impotence pill Viagra.

The EU's General Court ruled that the similarity allowed Viaguara "to take unfair advantage of the distinctive character or repute of the trademark Viagra."

The Polish company by the same name had already applied for the EU trademark in 2005 but was refused. The court has now rejected the appeal. The General Court ruling itself can only be appealed on points of law.

The U.S. medical company Pfizer Inc. produces the erectile dysfunction pill Viagra.

Also because of the medical implications, the court said it was dangerous to let a mental link exist.

"Even if the non-alcoholic drinks concerned do not actually have the same benefits as a drug to treat erectile dysfunction, the consumer will be inclined to buy them thinking that he will find similar qualities, such as an increase in libido," the court said in a statement.

Pfizer welcomed the ruling. If Viaguara had been allowed to co-exist "the public would likely establish a 'link' between the two marks and Viaguara would take unfair advantage of the distinctive character or the repute of Pfizer's well-known trademark," the company said in a statement.

Pfizer said that since its introduction in 1998, Viagra has been prescribed to more than 37 million men worldwide.

Ex-Irish senator arrested over suspicious expenses (AP)

DUBLIN ? A former Irish senator who became a lightening rod for voter anger against politicians' outrageous expense claims was arrested Wednesday over his submission of allegedly forged receipts from a long-dead company.

Detectives said Ivor Callely, 53, would be questioned on suspicion of using fake invoices to rip off taxpayers, a crime with a maximum penalty of 10 years in prison.

Despite being repeatedly pressed by journalists, Callely has never offered a credible explanation for why he claimed euro2,907 ($3,750) in expenses for bills supposedly issued by a small mobile-phone provider for the supply of four phones and hands-free car equipment from 2002 to 2005. The supposed supplier ceased business in 1994.

Parliamentary accountants cleared the payment in 2007. An Irish newspaper's freedom of information request exposed the suspicious claim in 2010. Callely said he then refunded the money and didn't know how the mistake happened.

Around the same time, another newspaper's FOI request discovered that Callely had claimed more than euro81,000 ($105,000) in expenses by saying he was commuting almost daily from his family's holiday home in rural County Cork, 370 kilometers (230 miles) from Dublin. He even claimed euro140 per day in overnight-travel benefits each time he stayed in his Dublin home.

The prime minister demanded an explanation, commentators branded his claim to be a Cork resident implausible, given he represented a Dublin district, and his fellow senators suspended him from office for 20 days without pay.

But Callely successfully sued the senate in Dublin's High Court and won euro17,000 ($22,000) in damages for lost wages. The January 2011 judgment deemed the senate's suspension procedures unfair and its weak expense rules open to the two-home loophole that Callely exploited.

Callely served 18 years as a lawmaker in Ireland's key lower house of parliament, Dail Eireann. When he failed to win re-election in 2007, the government appointed him to the broadly irrelevant upper house, called the Seanad.

In 2005 Callely was forced to resign as the government's minister for traffic, road haulage and aviation after Irish state broadcasters RTE reported that a construction company competing for government contracts had painted his home ? in Dublin, not Cork ? for free.

Callely is hardly the biggest offender in Ireland's pantheon of benefit-taking politicians.

A series of state-ordered investigations since 1996 has discovered that one former prime minister, Charles Haughey, collected more than euro11 million in secret cash payments from business friends while in office; a former justice minister, Ray Burke, received a free house from a developer and many other corrupt payments that he hid in offshore accounts; and former premier Bertie Ahern deposited his own array of ill-documented cash payments from business friends in personal safes rather than banks.

Only Burke was jailed, briefly, for tax evasion.

Iran steps up threats to shutter Strait of Hormuz (AP)

TEHRAN, Iran ? Two Iranian lawmakers on Monday stepped up threats their country would shutter the strategic Strait of Hormuz, through which a fifth of the world's crude flows, in retaliation for oil sanctions on Tehran.

The warnings came as EU nations agreed in Brussels on an oil embargo against Iran as part of sanctions over the country's controversial nuclear program. The measure includes an immediate embargo on new contracts for Iranian crude and petroleum products while existing ones are allowed to run until July.

Iran has repeatedly warned it would choke off the strait if sanctions affect its oil sales, and two lawmakers ratcheted up the rhetoric on Monday.

Lawmaker Mohammad Ismail Kowsari, deputy head of Iran's influential committee on national security, said the strait "would definitely be closed if the sale of Iranian oil is violated in any way."

Kowsari claimed that in case of the strait's closure, the U.S. and its allies would not be able to reopen the route, and warned America not to attempt any "military adventurism."

Another senior lawmaker, Heshmatollah Falahatpisheh, said Iran has the right to shutter Hormuz in retaliation for oil sanctions and that the closure was increasingly probable, according to the semiofficial Mehr news agency.

"In case of threat, the closure of the Strait of Hormuz is one of Iran's rights," Falahatpisheh said. "So far, Iran has not used this privilege."

Monday's EU measure also includes a freeze on the assets of Iran's central bank as part of sanctions meant to pressure Tehran to resume talks on its uranium enrichment, a process that can lead to making nuclear weapons. Iran insists its nuclear program is exclusively for peaceful purposes.

For its part, the United States has enacted, but not yet put into force, sanctions targeting Iran's central bank and, by extension, the country's ability to be paid for its oil.

Some 80 percent of Iran's oil revenue comes from exports and any measures or sanctions taken that affect its ability to export oil could hit hard at its economy. With about 4 million barrels per day, Iran is the second largest producer in OPEC.

Tensions over the strait and the potential impact on global oil supplies and also the price of crude have weighed heavily on consumers and traders. Both the U.S. and Britain have warned Iran over any disruption to the world's oil supply through he strait.

Another Iranian lawmaker, Ali Adyani, sought to downplay the latest EU move, describing it as a "mere propaganda gesture," according to the semiofficial Fars news agency.

Former intelligence minister, Ali Falahaian, suggested Iran should stop all its crude exports "so that oil prices would go up and the Europeans' sanctions would collapse."

Threats to close the strait escalated during Iran's naval exercises in the Persian Gulf in January. Iran plans more naval war games in February.

Marine accepts plea deal in Iraqi civilian deaths

CAMP PENDLETON, Calif. (AP) ? A Marine sergeant who told his troops to "shoot first, ask questions later" in a raid that killed unarmed Iraqi women, children and elderly pleaded guilty Monday in a deal that will carry no more than three months confinement and end the largest and longest-running criminal case against U.S. troops from the Iraq War.

The agreement marked a stunning and muted end to the case once described as the Iraq War's version of the My Lai massacre in Vietnam. The government failed to get one manslaughter conviction in the case that implicated eight Marines in the deaths of 24 Iraqis in the town of Haditha in 2005.

Staff Sgt. Frank Wuterich, 31, of Meriden, Conn., who was originally accused of unpremeditated murder, pleaded guilty to negligent dereliction of duty for leading his troops to disregard rules of combat when they raided homes after a roadside bomb exploded near their convoy, killing one Marine and wounding two others.

The Haditha incident is considered among the war's defining moments, further tainting America's reputation when it was already at a low point after the release of photos of prisoner abuse by U.S. soldiers at Abu Ghraib prison.

"The case doesn't end with a bang, it ends with a whimper and a pretty weak whimper at that," said Gary Solis, a former Marine Corps prosecutor and judge. "When you have 24 dead bodies and you get dereliction of duty, that's pretty good defense work."

Wuterich, his family and his attorneys declined to comment after he entered the plea that halted his manslaughter trial at Camp Pendleton before a jury of combat Marines who served in Iraq.

Prosecutors also declined to comment on the plea deal. Marine Corps spokesman Lt. Col. Joseph Kloppel said the deal was not a reflection or in any way connected to how the prosecution felt their case was going in the trial.

Wuterich, the father of three children, had faced the possibility of life behind bars when he was charged with nine counts of manslaughter, among other charges.

The prosecution implicated him in 19 of the 24 deaths.

The manslaughter charges will be dropped now that Wuterich has pleaded guilty to the minor dereliction of duty charge. As a result, he faces a maximum of three months in confinement, two-thirds forfeiture of pay and a rank demotion to private when he's sentenced.

Both sides will present arguments Tuesday during a sentencing hearing. Seven other Marines were acquitted or had charges dismissed in the case.

The killings still fuel anger in Iraq after becoming the primary reason behind demands that U.S. troops not be given immunity from their court system.

Kamil al-Dulaimi, a Sunni lawmaker from the Anbar provincial capital of Ramadi, called the plea deal a travesty of justice for the victims and their families.

"It's just another barbaric act of Americans against Iraqis," al-Dulaimi told The Associated Press. "They spill the blood of Iraqis and get this worthless sentence for the savage crime against innocent civilians."

News of the plea agreement came late in the evening in Iraq, just hours before curfew most cities still impose, producing no noticeable public reaction. Government officials didn't immediately respond to requests for comment.

The issue at the court martial was whether Wuterich reacted appropriately as a Marine squad leader in protecting his troops in the midst of a chaotic war or disregarded combat rules and ordered his men to shoot and blast indiscriminately at Iraqi civilians.

Prosecutors said he lost control after seeing the body of his friend blown apart by the bomb and led his men on a rampage in which they stormed two nearby homes, blasting their way in with gunfire and grenades. Among the dead was a man in a wheelchair.

Wuterich has said he regretted the loss of civilian lives but believed he was operating within military combat rules.

During Monday's hearing, he acknowledged he told the squad before the raids to shoot without hesitation, leading them to believe they could ignore the rules of combat. He told the judge that caused "tragic events."

"I think we all understood what we were doing so I probably just should have said nothing," Wuterich told the judge, Lt. Col. David Jones.

He admitted he did not positively identify his targets, as he had been trained to do. He also said he ordered his troops to assault the homes based on the guidance of his platoon commander at the time.

Wuterich also acknowledged in his plea that the squad did not take any gunfire during the 45-minute raid on the homes or find any weapons.

After Haditha, Marine commanders ordered troops to try and distinguish between civilians and combatants.

The prosecution had several squad members testify, but many said they do not believe to this day that they did anything wrong because they feared insurgents were inside hiding. Several also acknowledged lying to investigators in the past, leaving doubt about their credibility.

The prosecution was further hurt by the testimony of former Lt. William T. Kallop, Wuterich's former platoon commander, who said the squad was justified in its actions because the house was declared hostile. From what was understood of the rules of combat at the time, that meant Marines could attack without hesitation, Kallop said.

Legal experts say the prosecution had an uphill battle because of the delay caused by six years of pre-trial wrangling between the defense and prosecution, including over whether the military could use unaired outtakes from an interview Wuterich gave in 2007 to the CBS newsmagazine "60 Minutes."

Prosecutors eventually won that right but overestimated its value, analysts say.

Solis, the former military prosecutor, said the military should have pushed for an earlier trial to ensure witnesses' memories were fresh.

"Six years for a trial is unacceptable," said Solis, who teaches law of war at Georgetown University Law Center. "Delay is always to the benefit of the accused."

He said prosecutors may have been cowed by the Army's missteps in its handling of the death of former NFL star and Ranger Pat Tillman from friendly fire in Afghanistan in 2004.

Ruling that faults FBI is upheld in Bulger case (AP)

BOSTON ? A federal appeals court has upheld multimillion-dollar judgments that found the government liable for the deaths of three people allegedly murdered by James "Whitey" Bulger.

The U.S. Court of Appeals for the First Circuit upheld awards Friday that ranged from $350,000 to $1.3 million for the families of Debra Davis, Deborah Hussey and Louis Litif.

The court affirms a trial judge's decision that the FBI showed "wildly reckless behavior" in using Bulger and his associate, Stephen "The Rifleman" Flemmi, as informants and shielding them from prosecution.

Steve Davis, the brother of Debra Davis, tells The Boston Globe (http://bo.st/zzfKdP) that the appeals court's decision shows his sister mattered.

Bulger was arrested last year after 16 years on the run. He awaits trial on accusations of participating in 19 murders.

Razzies worst-movie awards shift to April Fool's (AP)

LOS ANGELES ? Hollywood's award season is going to linger on through April Fool's Day this year.

Organizers of the Razzies have changed the schedule for their nominations and prize ceremony. The spoof on the Academy Awards picks the year's worst films.

The Razzies used to announce contenders the night before the Oscar nominations, which are coming Tuesday.

Razzies founder John Wilson announced Sunday that nominations this season will be released Feb. 25, the eve of the Oscar ceremony. Winners of the Razzies will be announced on April 1.

Wilson says Razzies organizers have long wanted to have their awards coincide with April Fool's Day.

A news release announcing the change also notes that it will give the 600 Razzies voters "additional time to see the dreck they will eventually nominate."

CAMBRIDGE, Mass. ? Golden Globe winner Claire Danes will be picking up a pudding pot from Harvard's Hasty Pudding Theatricals.

The student group named Danes on Friday as its Woman of the Year. She'll get a parade and a roast Jan. 26.

Danes won her third Golden Globe on Sunday for her role as CIA agent Carrie Mathison on Showtime's new "Homeland." She won a Golden Globe, an Emmy and a Screen Actors Guild award last year for her work in HBO's "Temple Grandin."

How the major stock indexes fared on Thursday (AP)

Strong corporate earnings reports and the lowest unemployment claims in almost four years gave investors more reasons to take risks on stocks Thursday, and the market continued its quiet but solid January climb.

The Dow Jones industrial average rose 45.03 points, or 0.4 percent, to close at 12,623.98.

The Standard & Poor's 500 index gained 6.46 points, or 0.5 percent, to 1,314.50.

The Nasdaq composite index added 18.62 points, or 0.7 percent, to 2,788.33.

For the week:

The Dow is up 201.92, or 1.6 percent.

The S&P 500 is up 25.41, or 2 percent.

The Nasdaq is up 77.66, or 2.9 percent.

For the year to date:

The Dow is up 406.42, or 3.3 percent.

US, Europe trying to pressure Iran into nuke talks

(AP) ? The United States and its European allies joined Friday in saying they would try to pressure Iran back into nuclear negotiations despite the Islamic republic's failure after three months to answer the nations' terms for talks.

Secretary of State Hillary Rodham Clinton said the U.S. and its partners were making it clear to Tehran that it was headed down a "dangerous path" with its pursuit of nuclear weapons and threats to close off the Strait of Hormuz ? through which much of the world's fuel travels to reach international markets.

"Iran does have a choice to make," Clinton told reporters in Washington after meeting German Foreign Minister Guido Westerwelle.

"It can come back to the table ... and address the nuclear program concerns that the international community rightly has, or face increasing pressure and isolation," she said. "The country can be reintegrated into the global community, able to share in the benefits, when their government definitely turns away from pursuing nuclear weapons."

Clinton spoke after the European Union released a letter it sent to Iran in October, imploring renewed talks to answer the international concerns about Iran's uranium enrichment activity. The West fears it is aimed at developing nuclear weapons, but Tehran insists the work is for energy and research purposes.

EU foreign policy chief Catherine Ashton said Friday the international community remained open to talks with Iran, even as a blocwide embargo on Iranian oil appeared set for approval Monday. She said world powers have shown a "continued willingness to engage" Iran, but have received no reply to their Oct. 21 offer of more talks.

The letter she sent to Saeed Jalili, Iran's top nuclear negotiator, states the overall goal of a negotiated solution that "restores international confidence in the exclusively peaceful nature of Iran's nuclear program."

The pressure coincided with work in European capitals ahead of the likely approval Monday in Brussels of new restrictions on Iranian oil. The embargo would immediately prohibit the signing of any new oil contracts with Iran, diplomats said, though the details of the embargo will be left for later.

The details would include the date when existing contracts to buy Iranian oil would no longer be valid. Britain, Germany and France are eager for a strong and quickly implemented embargo on Iranian oil, but financially strapped Greece benefits from low prices it pays for Iranian fuel. It wants assurances that the embargo will not become a financial burden it cannot bear.

Meanwhile, French President Nicolas Sarkozy urged stronger, more decisive sanctions against Iran, including a continentwide freeze on international assets of Iran's central bank. In an annual speech on French diplomacy Friday, Sarkozy accused Iran of lying and denounced what he called its "senseless race for a nuclear bomb."

"Time is running out," he said. "Everything must be done to avoid" international military intervention.

Wikipedia dark, Google lobbies in protest of anti-piracy bill


SAN FRANCISCO (Reuters) - The English page of Wikipedia, the world's free online encyclopedia, was dark on Wednesday except for a paragraph urging users to protest legislation designed to stop copyright piracy, but that Wikipedia says "could fatally damage the free and open Internet."

Google's home search page has the logo: "Tell Congress: Please don't censor the web!"

Smaller sites, such as Reddit.com and BoingBoing.net, were also dark, with BoingBoing noting that the proposed anti-piracy bills "would put us in legal jeopardy if we linked to a site anywhere online that had links to copyright infringement."

The companies oppose bills designed to curb access and payments to overseas websites that traffic in stolen content or counterfeit goods on the grounds that it could put them in legal peril.

The legislation has been a major priority for entertainment companies, publishers, pharmaceutical companies and many industry groups. They maintain the proposed law is critical to curbing online piracy they say costs them billions of dollars annually.

Internet companies have furiously opposed the legislation and have stepped up lobbying efforts in recent months, arguing it would undermine innovation and free speech rights, compromise the functioning of the Internet, and would be ineffective in stopping piracy.

The bills were seemingly on the fast track for approval by Congress until the White House criticized aspects of it over the weekend.

Big tech names including Facebook and Twitter declined to participate despite their opposition to the House of Representatives' Stop Online Piracy Act (SOPA) and the Senate's PROTECT Intellectual Property Act (PIPA). The companies were not prepared to sacrifice a day's worth of revenue and risk the ire of users for a protest whose impact on lawmakers would be hard to gauge.

Google's solution allows the search engine giant to keep revenue attached to its searches, while still highlighting the issue.

"This publicity stunt does a disservice to its users by promoting fear instead of facts," said Lamar Smith, chairman of the House Judiciary Committee and a sponsor of SOPA. "Perhaps during the blackout, Internet users can look elsewhere for an accurate definition of online piracy."

Former Senator Chris Dodd, who now chairs the Motion Picture Association of America, labeled the blackout a "gimmick" and called for its supporters to "stop the hyperbole and PR stunts and engage in meaningful efforts to combat piracy."

Bill Allison, editorial director of the Sunlight Foundation, which aims to create a transparent government, said the in-your-face public lobbying effort was "very effective."

"It's a way of engaging the public in something that had been a very much behind closed doors kind of business as usual in Washington thing," he said. "Obviously lobbying and campaign contributions are important, but members of Congress still need to get 50 percent of the vote. If a significant portion of their constituents are affected by something ... and go to the other side, you can lose your seat. That's what makes this such an interesting confrontation right now."

Inter full of optimism after emotional derby win

ROME (AP) -Inter Milan is full of optimism following an emotional derby win over AC Milan that is helping the club forget its dismal start to the season.

With six consecutive victories, the Nerazzurri have climbed from 15 points behind to trail Serie A leader Juventus by six points approaching the season's midpoint.

Inter remains at the San Siro this weekend to face fourth-place Lazio, the squad that is only one point above it in the table.

"This is a squad that should be fighting for the title," Inter manager Claudio Ranieri said. "We've had an incredible run but we still haven't done anything. We've gotten back in the (Europa League) zone but we've got to get back in the Champions League places - because that's where Inter belongs. We're placing one brick at a time."

Speculation that Inter might sign Carlos Tevez from Manchester City has waned recently, since word that the Argentina international is close to a deal with Paris Saint-Germain.

"We've found a nice balance, and this kid who hasn't played for a long time, how much could he offer and how much could he take away?" Ranieri said.

Inter began the season by failing to win its opening three matches, leading the club to replace Gian Piero Gasperini with Ranieri, although the real problem appeared to be Samuel Eto'o's sudden departure to Russian club Anzhi Makhachkala in August.

Eto'o led Inter with 37 goals in all competitions last season.

After a disappointing season and a half, Diego Milito finally appears to have rediscovered the goalscoring touch that helped lead Inter to an unprecedented treble in 2010.

Milito's 54th-minute goal against Milan last weekend was his fourth in three games.

Also, key playmaker Wesley Sneijder has returned after missing more than two months with a right leg muscle injury.

"When I arrived everything was going wrong, but I've re-instilled in everyone the desire to battle and show that they're not finished," Ranieri said. "I've put everyone back into their natural positions and working with these guys is a real pleasure."

While Inter was hosting Genoa on Thursday for a spot in the Italian Cup quarterfinals, it's real focus now is on Lazio, which exceeded expectations in the first half of the season but then was routed 4-0 by Siena in its first match after the holiday break.

Lazio got back on track with a 2-0 win over Atalanta last weekend with an opening goal from Brazilian playmaker Hernanes and then Miroslav Klose's 10th league score of the season in stoppage time.

"After the vacation it's not unexpected to have a blackout because you're not used to certain rhythms," said Lazio coach Edy Reja, the oldest manager in the league at 66. "Let's hope that letdown we had is over now. ... We're going to Milan to win."

Juventus, which leads Milan by one point, visits Atalanta, while Milan plays at last-place Novara in a rematch of an Italian Cup game won 2-1 by the Rossoneri in extra time on Wednesday.

"We lost but we're still five points in front of Inter," Milan striker Zlatan Ibrahimovic said. "There are still a lot of matches remaining, so that game wasn't decisive."

Third-place Udinese, which is three points behind, hosts Catania.

Now NY's Legislature gets Cuomo's budget (AP)

ALBANY, N.Y. ? With a little cheerleading, a little cajoling and a little threatening, Gov. Andrew Cuomo has turned his 2012-13 budget into a rallying cry for reform of the status quo in Albany, demonizing some of its most powerful public labor unions.

The Democrat again cast himself as the outsider in Tuesday's presentation of his mostly flat $132.5 billion budget. He called for reform of the status quo of the Capitol he's been part of for 30 years since his father, former Gov. Mario Cuomo, held the office and after spending his own first year pulling the strings of state government more than any governor in decades.

"We created a sense of optimism and hope," Cuomo told lawmakers as he called the first-year accomplishments of himself and the Legislature staggeringly successful. New Yorkers "believe in government. ... They have hope once again for themselves, their state, their families and their communities and that is a great, great gift."

Cuomo seized the moment Tuesday in the state theater, well chilled as usual for when he speaks to a big crowd to keep spectators from acting logy from body heat. The budget address was one of only two certain joint meetings all year with intense statewide media attention.

Along the way, he made it clear to lawmakers from both parties that this legislative election year voters will either see them as partners in another year of "all-star" accomplishments, or as obstacles.

"This is a pro-economic growth strategy based on fiscal discipline, real reform and the exciting area of entrepreneurial government to lead us to a new New York," Cuomo said. "This is posing dramatic change in the system ... what we're talking about here are major shifts. Don't underestimate what we are trying to achieve ... we're changing it from the special interest focus to focus on the people."

One of Cuomo's biggest targets was the state's teachers unions, which he accused of blocking a tougher evaluation system for teachers that is threatening nearly $700 million in federal Race to the Top funds that require the action. The other big targets were the other major public employee unions that Cuomo wants to be forced to accept a new pension plan that would cut state and local government pension costs in half.

"I'm not sure we're going to adopt every last thing that he presented today, but if we can make progress on some of the big ones, I think the education piece is critical," said Senate Deputy Majority Leader Thomas Libous, a Broome County Republican. "We can't afford to lose money."

"If you lose funding, you lose jobs," said Assembly Speaker Sheldon Silver, a Manhattan Democrat. "So I think you'll see a lot of agreements across the state, and I think that's fine."

Silver also said he'd be open to discussing Cuomo's pension proposal, a long simmering proposal pushed by Senate Republicans and local governments with lighter ties to powerful public unions than Assembly Democrats.

"I think you've got to look at it," Silver said, "because that option saves a significant amount of money."

Cuomo's overall budget proposal would increase state spending by 2 percent, much of it involving 4-percent school aid and Medicaid spending hikes agreed to last year with legislative leaders. But the overall plan, including federal funding, is a fraction of 1 percent lower than the current budget, and eliminates a $2 billion deficit. Cuomo's plan calls for using $1.9 billion in revenue from a "millionaire tax" approved in December and making just over $1 billion in cuts while embarking on a three-year takeover of Medicaid costs from local governments, now cracking under the $8 billion a year strain.

Cuomo's proposal would also merge some state agencies and withhold increases in state aid to school districts that fail to enact tougher evaluations for teachers and principals. Failure to do so threatens $700 million in federal Race to the Top grants.

Union leaders ? primarily those representing teachers and public employees ? signaled Cuomo would get fierce opposition.

Richard Iannuzzi, president of the New York State United Teachers union, said Cuomo's 4-percent increase for school aid is still $500 million short, and he'll pursue those funds in the Legislature.

Cuomo also wants a less costly pension tier for new hires, including a voluntary retirement using a type of 401(k) plan that would save state and local governments billions of dollars over 30 years.

"The proposal for a new public employee pension tier is an assault on the middle class and a cheap shot at public employees," said Danny Donohue, president of the Civil Service Employees Association union with 265,000 members. "It will provide no short-term savings and will mean people will have to work longer, pay more and gain less benefit."

But Cuomo was engaging in a fight some budget analysts have long sought in Albany.

"This budget, if enacted, will mark a second year of serious reform for New York state," said Elizabeth Lynam of the independent Citizens Budget Commission.

Like many who watched Albany through years of partisanship that threatened officials' once certain re-election bids, she was skeptical of the policies adopted last year that replaced the usual months-long battles over funding, rather than managing the funds.

"Now, they really seemed to have been able to focus on some of these key issues," Lynam said.
