Legal experts: Don't expect Knox to return for second trial

Knox is escorted to a hearing in 2008 (AP)

An Italian supreme court overturned the acquittal of Amanda Knox on Tuesday, ordering a review that could result in demanding that the 25-year-old return to Florence to stand trial again in the 2007 killing of her roommate.

Good luck.

Legal experts say there's little Italy can do to force Knox, who lives in Seattle, to return for the new hearings, and Knox's lawyers say there's no reason she would agree to do so.

?Merely because they have sent it back for revision does not mean that anything else will happen," Theodore Simon, one of Knox's lawyers, said in an interview with the "Today" show. "They will review it. They may simply affirm that there was a ?not guilty? before and it should remain the same. They may seek to take some further evidence, but nothing has really changed.?

[Related slideshow: The Amanda Knox trial]

Italian law cannot compel Knox to return to Italy for a new trial, although a court could declare her in contempt if she refused to appear. But even if that happened, the contempt charge would carry no additional penalties, the Associated Press said.

"If the court orders another trial, if she is convicted at that trial and if the conviction is upheld by the highest court, then Italy could seek her extradition," Carlo Dalla Vedova, another lawyer for Knox, told the news service. In that scenario, the United States would have to agree to extradite her.

That would seem unlikely since it violates the U.S. legal principle of double jeopardy preventing someone from being tried twice for the same crime. But Vedova told the New York Times it does not apply in this case because there had been no final ruling.

More from the AP:

It is unclear what would happen if she were convicted and sentenced to further prison time. It is possible Italy could seek her extradition, or that U.S. and Italian authorities could come to a deal that would keep her in the United States.

The new hearings will be held at an appellate court in Florence sometime later this year or early next year, the Italian court said.

In a statement released Tuesday, Knox called the court's decision "painful" since "the prosecution's theory of my involvement in Meredith's murder has been repeatedly revealed to be completely unfounded and unfair."

In 2011, Knox and Raffaele Sollecito, her former boyfriend, were acquitted in the murder of Meredith Kercher, a British student who was found dead in the Perugia, Umbria, apartment she shared with Knox, half naked with her throat slashed. Knox and Sollecito each spent four years in prison before the acquittal.

"The prosecution responsible for the many discrepancies in their work must be made to answer for them, for Raffaele's sake, my sake, and most especially for the sake of Meredith's family," Knox said. "Our hearts go out to them. No matter what happens, my family and I will face this continuing legal battle as we always have, confident in the truth and with our heads held high in the face of wrongful accusations and unreasonable adversity."

Knox's book about the case?"Waiting to Be Heard"?is due to be released next month.

This Man Crafts Some of the Most Intricate Ship-In-a-Bottle Dioramas You've Ever Seen

Throughout his entire life, Ray Gascoigne had a connection with the sea. He's worked as a shipwright, a sailor, and now that he's retired he still spends his days working on boats—just on a smaller scale. When it comes to the ship-in-a-bottle, Ray is a master craftsman who makes designing tiny boats that can slip through the neck of a bottle look like child's play. More »

Google Analytics Now Makes It Easier To Track Inbound Links And Stats From Its Social Hub Partners

Image (1) google-analytics-logo.png for post 23767Google today announced that it has redesigned some of Google Analytics‘ social reports to make it easier for publishers to see when they get inbound links from other sites. The update also makes it easier to track how people are engaging with a publisher’s content through the new Data Hub Activity report. Google Analytics’ Social Data Hub gets this data from partner sites like Reddit, and Digg, through commenting systems like Disqus, Echo and Livefyre, as well as a number of other services. The standalone Data Hub Activity report provides publishers with a “timeline of the number of activities that have occurred in the Social Data Hub and the raw activities in a list below.” The data can also be filtered by specific networks. This Social Hub data was already available previously, but it was mostly buried inside Google Analytics’ social reports. Now that this data is more visible, integrating with the Analytics Social Data Hub will surely become more interesting for companies that operate social networks and platforms, as more Analytics users will now be aware of it and ask for this kind of integration so they can track their social engagement data in one place. Stats about trackbacks, too, were already available in Google Analytics, but they are now available in a standalone report. Previously, however, it was hard to see how important a certain inbound link really was. The new report, Google says, now provides more context “for the significance of each of these trackbacks by displaying the number of visits that were driven by each endorsing URL during the reporting period.”

Nook for iOS supports Nook Comics, highres magazines on iPads

Barnes & Noble may have saved most of the limelight today for in-app purchasing on Nook hardware, but it's not leaving other platforms by the wayside. Its Nook 3.4 update for iOS focuses heavily on visuals, with new support for both Nook Comics as well as "HD" magazines on Retina display-equipped iPads. Likewise, there's some spring cleaning afoot: the app offers better organization for periodicals, the option to expand book illustrations and newly animated page turns. Swing by the App Store if you've got enough of a toehold in Barnes & Noble's ecosystem to use its software.

New ESCEO and IOF Guidance highlights new risk assessment and treatment strategies; points to high prevalence of fractures and low rates of diagnosis and treatment in Europe

A new Guidance recently published by the European Society for Clinical and Economic Aspects of Osteoporosis (ESCEO) and the International Osteoporosis Foundation (IOF) reflects the most current advances in the diagnosis and management of osteoporosis, the 'silent disease' which affects up to one in two postmenopausal women.

"The serious impact of fragility fractures due to osteoporosis is vastly underestimated by many health care professionals," stated ESCEO President Professor Jean-Yves Reginster.

"Statistics clearly show that fragility fractures in older adults can result in early death or lead to long-term disability, diminished quality of life and loss of physical independence. Nevertheless, diagnosis and treatment rates are appallingly low, even among those patients who have already suffered a fracture. Barely 20% of these clearly 'high risk' patients receive treatment to prevent future fractures," he said.

The 2013 European Guidance for the Diagnosis & Management of Osteoporosis in Postmenopausal Women, published in Osteoporosis International, is an update of the ESCEO Guidance published in 2008. The new report reflects the significant advances in the field over the past five years, including the development of new techniques for measuring bone mineral density, improved methods of assessing fracture risk and new treatments that significantly reduce the risk of fractures.

The Guidance highlights the following:

  • Statistics related to cost and prevalence, morbidity and mortality in Europe
  • Diagnostic guidelines and risk factors
  • Management algorithm for the assessment of fracture risk with FRAX
  • Intervention thresholds
  • Assessment of fracture risk with limited or unlimited access to BMD using DXA
  • General management regarding mobility and falls
  • Nutrition recommendations
  • Diagnostic work-up of patients with osteoporosis
  • Anti-fracture efficacy of major interventions for postmenopausal osteoporosis

IOF President John Kanis commented, "Although this new Guidance is written from a European regional perspective, we hope that it will help inform the development or revision of guidelines at the national level, both in Europe and around the world. Given the serious impact of fractures on women's health worldwide, it is essential that clinicians are sensitized to the need for early diagnosis and treatment and are able to implement the latest strategies for the benefit of their patients."

PFT: Johnson miffed by Titans' signing of Greene

McKayAP

Plenty of fans think that the move to make pro football safer comes from a desire to protect the coffers against future litigation filed by the players of today.

Falcons president Rich McKay, who chairs the league?s Competition Committee, addressed that concern during a Thursday visit to Pro Football Talk.

?Absolutely not,? McKay said, ?it?s about protecting the players.? I?ve been on the Committee for 20 years and it?s never been a discussion in our room of, ?Well we?re worried about a litigation about this or a litigation about a knee injury.?? We?re worried about player safety and I think one of the great things about the league is it?s been a focus of ours for a long time and there?s such a long process that goes into it.

?People think that, well, there?s a Competition Committee, they take guys, and they come up with these rules. There?s such a long process. This is a rule we?ve actually talked about for a couple of years with the [NFL] Players Association, with the Head, Neck, and Spine Committee, with Coach Madden?s subcommittee, all of those things.? So the reasoning behind these rules is, number one, the short-term health and safety of the players and, number two, the long-term health and safety of our players.?

McKay has no concern regarding the potential impact of enhanced safety rules on the long-term welfare of the game. At some point, could another league that promises ?old-school? football with big hits and players willing to take the risks emerge to threaten the NFL?

?No, I don?t think so, Mike, and I?ll tell you why,? McKay said. ?It doesn?t mean that there couldn?t be another league; obviously there could be at any time.? But remember what football is.? Football is the ultimate team sport and it begins at a very young age and we?re the leaders of that sport and we take the responsibility for that.? So if we ever get the mindset that, hey, we have to leave this game as tough as it is and in some way we don?t encourage younger players to play our game then be assured of this, in time it will affect our game.? It will have an effect and that?s something that we can never forget and that?s why we always say when we pass rule changes, we?re passing it hoping to force it all the way down to the littlest guys playing our game and so that everybody understands how safe our game can be.

?So the fact that somebody may decide to play ultimate football or ultimate whatever, fine for them.? But in our game we?re always going to look out for the entire game, that starts from the little guys playing football, high school football, college football, and us because what?s made us great is that entire feeder system of that chain has made our game as great as it is.?

It?s a responsible and prudent approach, but the resistance from players and criticism from fans suggests that, eventually, a league that plays football ?the way it used to be played? could pose a threat to the NFL?s future.? Then again, if parents view the game as unacceptably dangerous, the supply of football players eventually will be choked off.

Obama visits Bethlehem's Nativity Church

By Matt Spetalnick and Ali Sawafta

BETHLEHEM, West Bank (Reuters) - President Barack Obama made a pilgrimage on Friday to the traditional birthplace of Jesus, receiving a subdued reception from Palestinians at the end of a Holy Land visit heavy on symbolism and lacking in practical steps toward peace.

"Gringo, return to your country," read a sign held by a small group of Palestinian protesters who watched the presidential motorcade roll into Bethlehem from Jerusalem after it passed through Israel's controversial barrier in the occupied West Bank.

Sparse crowds of onlookers were on the streets of the wind-swept Biblical city, where Obama spent only 35 minutes, the final stage of his three-day visit to Israel and the Palestinian Territories.

At the Church of the Nativity, built above the grotto where Christians believe Jesus was born, Obama and Palestinian President Mahmoud Abbas chatted amiably.

A day earlier, in the West Bank city of Ramallah, Obama urged Abbas to return to peace talks with Israel unconditionally, but there was no sign the Western-backed Palestinian leader would do so.

Abbas has said Israel must first stop its settlement activity in the West Bank before any resumption of the U.S.-sponsored negotiations, frozen since 2010 over the issue.

In Israel, Obama has tried to win over a skeptical public, assuring them of full U.S. support at a time of growing tensions with Iran over its nuclear ambitions and anxiety over the civil war in neighboring Syria.

But in a speech in Jerusalem on Thursday, he also urged Israelis to push their leaders to take risks and secure peace with the stateless Palestinians, calling on his audience of university students to put themselves in the shoes of their occupied neighbors.

ISRAELI SYMBOLS

At the Church of the Nativity, Obama ducked to enter through its small Door of Humility. Manger Square, the plaza in front of the church, was almost deserted except for security personnel.

A few waiters watched from a nearby restaurant and souvenir shops were almost empty or shuttered.

Earlier, Obama visited Israel's most powerful national symbols, paying homage at the Holocaust memorial and the graves of Theodor Herzl, the founder of modern Zionism, and Yitzhak Rabin, the prime minister assassinated in 1995 by an extremist Jew over peace moves with the Palestinians.

Wearing a Jewish skullcap, Obama rekindled an eternal flame at the Yad Vashem memorial next to a stone slab above ashes recovered from Nazi extermination camps after World War Two.

"We have a choice to acquiesce to evil or make real our solemn vow - never again," Obama said.

Officials said the visits to Yad Vashem and the Mount Herzl cemetery in Jerusalem were aimed at correcting an impression the president had given in a speech in Cairo in 2009, where he appeared to argue that the legitimacy of the Jewish state stemmed from the Holocaust.

At Yad Vashem, Obama made clear he recognized that Jewish roots to the Holy Land were centuries-old.

"Here on your ancient land, let it be said for all the world to hear, the state of Israel does not exist because of the Holocaust, but with the survival of a strong Jewish state of Israel, such a Holocaust will never happen again," he said.

Obama has reiterated to Israeli Prime Minister Benjamin Netanyahu that settlement building in the West Bank, land the Palestinians want as part of a future state, was detrimental to peace efforts.

But he retreated from the overt calls during his first term for a halt to the building and he has offered no new peace initiative during his trip, saying he had just come to listen.

Obama held a final round of talks with Netanyahu on Friday before flying to Jordan to discuss with King Abdullah an array of problems, including Syria and stalled Israeli-Palestinian peace moves.

Obama hopes to reassure Abdullah of Washington's support at a time when Jordan is flooded with refugees from Syria and battling economic difficulties and tensions from the "Arab Spring", aides say.

While Washington backs the Syrian opposition's effort to oust President Bashar al-Assad, it has limited its support to non-lethal aid to anti-government rebels despite growing calls from European and Gulf Arab allies to take a stronger tack.

The king has taken a mostly cautious line on Syria, calling for Assad to go, but advocating a political solution and not arming the Syrian leader's foes. Jordanian authorities worry that any emergence of Islamist rule in a post-Assad Syria could embolden Islamists who are the main opposition group in Jordan.

Jordan is one of only two Arab states - Egypt is the other - to have signed peace treaties with Israel and is seen as a potential player in any future U.S.-led peace push. It also has a majority Palestinian population.

Now the legendary brothers, Merrill, Jay and Jimmy bring their signature brand of entertainment to the Macomb Center for the Performing Arts for one extraordinary performance on Saturday, April 6 at 7:30 p.m.

Five decades ago, four young boys were flashed across national television screens on what was meant to be a one-time shot at ?the big time.? That single appearance led to such an overwhelming mail response that for the following seven seasons, The Osmond Brothers became regulars on the Andy Williams Show. From that point on, their name alone became synonymous with the ?big time? and everything associated with it. Their lives would never be the same, nor would those lives with whom they could come into contact.

The Osmonds are one of the most well-known entertainment families in the world. Their example of an unfailing belief in God and family, along with a wide-range of talent, creates the unique combination that has led to their tremendous success. Celebrating over 50 years in entertainment, music historians recognize them as the longest running group in history, having never disbanded. Their spirit of dedication and loyalty to the craft is felt and reciprocated by their equally dedicated and loyal following. It is this same spirit they bring to their many music styles.

The Osmond Brothers? career began in ?Barbershop? as young boys, and it is that familiar harmonizing that has become the ?signature? on their music. They skillfully play several musical instruments among them; dance, write music, and create electricity between stage and audience that can only be felt during an Osmond performance. The Osmond family has sold millions of records worldwide, earning them more than 53 gold and platinum records along with other prestigious awards. They surpassed both Elvis? and the Beatles? best single year success by being honored with nine gold records in 1971.

The Osmond Brothers have created a niche all their own in the field of entertainment.

Their remarkable success with pop, rock, country, jazz and gospel music has enabled them to touch audiences both young and old, and every age in between. 7 killed as explosion rocks Army depot in Nevada

A mortar explosion during a live-fire training exercise at an Army ammunitions depot in the Nevada desert has left at least six marines dead and others injured. NBC's Jim Miklaszewski reports.

By Jim Miklaszewski and Erin McClam, NBC News

Seven U.S. Marines were killed and at least seven wounded when a mortar exploded during a live-fire training exercise overnight at an Army munitions depot in the Nevada desert, military officials told NBC News.

There were conflicting reports about what happened. According to one account, a 60-millimeter mortar shell exploded in a tube as Marines were preparing to fire it. Another account said that the shell exploded as Marines were picking it up to load it.

The accident happened just before 10 p.m. Monday at Hawthorne Army Depot, a 230-square-mile ammunition storage and training facility just east of the California line.

The injured were taken to two hospitals. Stacy Kendall, a spokeswoman for Renown Regional Medical Center, a trauma center about 100 miles away in Reno, said the injuries included traumas and fractures.

The Marines were part of the 2nd Marine Division, a ground combat force based at Camp Lejeune, N.C.

The depot?s website says it is a training facility for the Army, Navy and Marines, including Special Operations forces preparing to deploy to the Middle East. The site says that the facility offers a ?realistic simulation of the situation in Afghanistan? because of the mountainous desert terrain.

A Marines spokesman said that the dead would be identified publicly 24 hours after their next of kin were notified.

?We send our prayers and condolences to the families of Marines involved in this tragic incident. We remain focused on ensuring that they are supported through this difficult time,? said Maj. Gen. Raymond C. Fox, commanding general of the 2nd Marine Expeditionary Force, which includes the 2nd Division. ?We mourn their loss, and it is with heavy hearts we remember their courage and sacrifice.?

Senate Majority Leader Harry Reid, who represents Nevada, offered condolences on the Senate floor. Nevada Sen. Dean Heller, a Republican, said on Twitter that ?thoughts and prayers are with the families who lost a loved one in the Hawthorne Army Depot explosion. Grateful for their service.?

Deaths in Libya from alcohol poison reaches 87

TRIPOLI, Libya (AP) ? Libya's health minister says the death toll from drinking homemade alcohol that contained poisonous methanol has risen to 87.

Minister Nouri Doghman says 1,044 people have been harmed.

He said Sunday that 15 people were blinded, and others went into comas or suffered kidney failure. He said some people admitted themselves to the hospital too late, contributing to the increasing toll.

The deaths were first reported a week ago.

The dead range in age from 19 to 50 years old.

The sale and consumption of alcohol is banned in the conservative North African country. Like illegal drugs elsewhere, some Libyans turn to black market dealers to buy alcohol, which is often cooked in homes or deserted farms.

The Patents I Never Filed?Multicast Networks ... - Business Insider

Anyone who follows me on Twitter or reads this blog knows I?m not a big fan of technology patents or patent law. I think they inhibit innovation and have become a weapon of small business destruction rather than a foundation of progress.

But that is not the point of this post.

Way back in the 1990s, Audionet/Broadcast.com was always having to invent new ways of streaming audio/video, presenting them to consumers and generating new revenue opportunities.

You know those pop up windows that Netflix has used for years? We created those. We called them ?Guaranteed Click Throughs? because we guaranteed that when a user clicked on them they would take you right to your website. We sold them for 25 cents EACH. That is how valuable traffic was back then.

Sure wish I patented them so I could prevent anyone else from ever using them!

There were some other things we were working on that I put together notes on. My lawyers wanted me to go through the entire process of patenting them. I just wanted to compete. So the patent applications never got past my note taking.

But in the interest of helping anyone who may ever face a patent troll on these topics, these are my notes. (And FWIW, I?m not saying these would definitely have gotten patents, and the in depth tech information is not in here. These were just notes to start a process that was never completed)

1. A Network of Multicast Networks

Invention Disclosure Form

Abstract (2-4 sentences): MultiNetworkMulticast Network ? A commercial network of multicast enabled networks. The composite of multiple Multcast enabled networks that terminates at a single point that enables digital content to be distributed in a one to many fashion across multiple networks from a single initiation point.?This enables providers of digital content to enable broadcast of those bits to an unlimited number of networks and hence, endpoints on that network of the content while only needing to enable a single source . ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ?

Conception date (describe any available written evidence of conception):?Oct 1996

List all contributors to the project from which the invention arose:?Mark Cuban, Kevin Smith? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ?

Has the invention been disclosed, or is it likely to be disclosed in the near future, to people or parties outside of the company? For example, has the invention been described, demonstrated or made available (i) to a vendor or customer; (ii) at a beta site; (iii) at a technical conference or trade show; (iv) or in a printed publication?? If so, provide the date and a description of each such disclosure and state whether the disclosure was subject to a non-disclosure agreement (NDA):?

Yes, the network is in use, and has been disclosed since Dec 1996

Identify each company project or product that utilizes or may utilize the invention.? Also list the current status of each such project or product, including any known or anticipated release, sales, shipping, beta testing, demonstration or public disclosure dates:

All streaming media and media distribution products used by the company benefits from this invention. The company has been working with commercial networks since 1996 to aggregate them into a single network. We have been building the network internally to link those networks, and have been testing the integration of application software to distribute those bits across multiple multicast enabled networks since January 1997.

We are currently actively working with Internet Service Providers and Network Backbone providers to integrate them into the process. Once integrated, the invention will allow us to distribute digital content in real time to a potentially unlimited size audience

Identify and describe any prior references that are relevant to the invention (e.g., known products, patents, publications, etc.):?

There exists a non profit network known as the Mbone. The mbone is a loosely coupled network of networks which can be joined or left at any point, without initiation or notice of departure. However, because it is not controlled or owned by any organization, there is no consistency for distribution on the network. There is no single point from which a content provider can go, link to? or integrate in order to assure the delivery of their digital content to all endpoints. We looked at this configuration and enhanced it by? creating defined links and destinations, creating the network of networks so that a content provider knows exactly what destination network endpoints are available, and the capabilities of those links??????????????????????????????????????????????????????????????????????????????????????? ??????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????? ???????????????????????????????????????????????????????????

State the problem that motivated or required the solution provided by your invention and briefly describe how your invention solves this problem:

In distributing digital content on the internet today, there is a huge problem of scale. Digital content is transmitted by sending a continuous stream of bits from an origination point, directly to a destination point in a 1 to 1 fashion. The problem is that number of destination points is limited by the amount of bandwidth available to the provider. So , to deliver 1gb of digital content to 100,000 users would require 100000000000000 bits of bandwidth!

The multicast protocol enables those same 1gb of content to be broadcast in a one to many fashion. However in order to receive those bits, users must be on a network that has been multicast enabled, and all the multicast networks that the desired audience exist on, must be linked to a common network. If the multicast enabled networks are not linked, then the content provider must originate content on each multicast enabled network separately.

By creating our network of networks, we enabled content providers to broadcast content one time to multiple multicast enabled networks. As a result, in the above example, only 1gb of bandwidth would be needed to reach those 100k users. ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ?

Describe how others have tried to solve the same or similar types of problems, and describe how your invention differs from those solutions:

Others have tried to create organizations that encouraged people to work together to try to solve this problem, but it has not happened until we did it.

Strategic Importance: Briefly state why this invention is strategically valuable to the company.? In other words, explain (i) how it would benefit the company to be able to prevent one of our competitors from using this technology; or (ii) why the company would care if one of our competitors could prevent us from using this technology:

The company has spent considerable dollars and resources to enable this invention and offer the benefit to our customers.? We have contractually tried to protect ourselves. However, if a company were to copy our efforts, they could offer the same level of savings to digital content providers thereby injuring our profit potential and market position.

2. Personalization System ? 1998 ? This was a system we had designed and had implemented a simple version of, with the below enhancements in progress

The goal of this system is to find out as much as we possibly can about our users by asking them questions, track? exactly what they listen or watch and for how long, to allow them to create a My.Yahoo.Com? that lists their favorite content, with reminders for scheduled programs/events and recommendations for comparable content along with community items such as related newsgroups, chats, and the like.

It starts with a user going to a? webpage where they provide us demographics information, and then choose the categories of content they like. They also pick their favorite teams, artists, companies they follow? and schedules.

From there a custom Player SMIL file is created so that the user can have their personalization features presented to them inside the player. It will look like My.Yahoo, only in the player. A comparable HTML page will be created as well. So they can interact in either way

In addition to listings , there will be a calendar feature that can be local on the hard drive, or on a webpage , but it is personalized with games , shows, events based on the items chosen and reminders requested.? The user should also be able to go to a master calendar and drag and drop to the personal calendar

There also needs to be a personalized ticker with hot text ads, prices of selected stocks, and alarms or reminders of events chosen.

There should be a search feature in the player, that allows the user to search Broadcast.com for other items, whether live or on demand

There must then of course be personalized advertising. Based upon the demographics information provided and upon the content, audio and video that the user accesses. This of course means that we will need to keep multiple master databases of users,? their unique ID, the unique ID assigned by the media player. This will allow us to say that sample user, who has these characteristics, is now about to watch? this music video, so deliver this specified gateway ad , and during the content, deliver these following types of ads. The ads will be defined based upon category like zones. There needs to be an unlimited number of these categories for us to sell.

There must be a means of commerce. Commerce entails two levels, one is to buy? impulse merchandise associated with the content. So it could be a trip to Dallas when listening to the zone if the user is from out of town, or a free coupon to a restaurant if the user is in town, and of course if the user is listening to a CD from the jukebox, they must be able to buy the CD.? There must also be the option, in certain instances to save the audio or video to disk for a fee. This requires us to define the content as an object with characteristics that enabled depending on the geography (some content may only be available to local residents), or on whether we have the download rights,? or whether we have it available for sale as a product.

The goal is to offer personalization, track, suggest and sell.

We will sell products, ads, gateway ads, in content ads, and who knows what other types of digital opportunities that arise.

3. Self Service Hosting 1998 ? Broadcast.com Personal Broadcast Network

The goal is to allow a person to come to simplenet (Broadcast.com?s hosting subsidiary) and select a hosting option that allows them to offer on demand or live streaming content. To make a choice as to the size audience they would like to reach, and to have options as to how they would like to be promoted.

The system must also have a calendar component so that content can be included in a schedule if live, or as part of a search engine of on demand.? The content must also have the option of being private and having a password assigned that the user can hand out to whoever they want, and that will secure the stream.

The system must accommodate what happens on the back end server as well and of course the whole thing must happen WITHOUT any hands on intervention. Each service/offering must be hands free, completely self service so that it can scale. The only exception is for encoded of sent items, which will be charged on a per hour basis for handling.

  1. User Gets a Welcome to the Broadcast.com Personal Broadcast Network
  2. Please download Your Personal Broadcast Station. This is our custom? version of the real and netshow encoders combined in a single package. When you run it, it asks the following questions.

?Do you want to broadcast in Audio or Video?

  1. Live -

Ask them for a description of the show. Different questions for audio and video. Video, is it from a camera, VCR, is it music, talk only, news, lots of motion, little motion, sports, whatever we can think of . This helps us determine what kind of quality and encoder settings to suggest, and what speed PC is necessary to encode ?The assumption is that all feeds will be delivered via a dialup internet connection

  1. The user is asked if this is the PC that will deliver the live feed
    1. If yes, a tracer is done and the network they are using is determined. It is compared to a list of good and bad networks and an interpretation is made of the likelihood of good connections. ie, if its AOL, or if tracert is over 250ms, then a warning is issued.
    2. The software then? reads the hardware config, the cpu config, who the ISP is from the Wininet, and the speed of the connection and reads their modem configuration, and then sends it to us or allows them to upload the file it creates to us

A, If its video, what kind of video card they are using to capture (To determine compatibility of encoders)

1. If they don?t know, or don?t have a compatible card, they are offered a list of cards that we will sell them, with an option to have a local reseller install for an additional $99.95. In addition, they are offered a complete PC setup with all the required pieces ready to go for $2495 for video.

2. They are asked what the video source is, camera, vcr,

3. They are asked what kind of computer and configuration it is to make sure it has enough horse power to encode live video

B. If its audio, same kind of questions as above. Ask them if they will be using the mic that came with their computer. Ask them if they will be mixing multiple sources. Ask them if this is talk, news, sports, music, what level of quality they want.

C. Give them the option of buying multiple radio station setups. From software to program a music station, software only, or computer included, to devices to do remotes, devices to take phone calls, etc.

D. Promotional Options

  1. Be listed in the Broadcast.com Personal Broadcast Network Schedule ? $5 per month
  2. Have a featured time that appears in the whats on now homepage of the Personal Broadcast Network . Only one per scheduled time. Each time has a specific price, and once its taken, its gone. So Monday, 5pm is, lets say $60, Tuesday 2 a.m. is $5

Be listed in the Main Broadcast.com Live Events Listing $100 per month

4?????? Buy Banners on Broadcast.com

General Rotation $30 CPM, minimum of $100

Specific Location $50 CPM, minimum of $100

  1. Select the pricing option

On demand ? Per Month $ 29.95 for 14.4, 59.95 for 28.8., for up to 4 hours of content. Up to 50 simultaneous users. 25% discount if they run our gateway ads prior and use our SMIL template

Live ? 24?7

28.8 audio or video 19.95 up to 10 simul users, if they run gw

ads, 29.95 if not.

288 audio or video, 99.95 up to 25 simul users, 149 up to 50

if they run our gateway ads. Without gateway ads, $149 and ????????????????????????????????????????????????????????????? $199.

Option to save and make available as archive is priced same as o????????????????????????????????????????????????????????? on demand.

Final option (Till we think of more things), is the reporting option. It's another $10 for monthly reports, $30 for weekly reports.

On the backend, once a user completes the information and their credit card is approved, the backend software checks our server farm to find the next available server. This server has its config file modified to create a user block (this is already setup to work in real, not sure about netshow), and assign a password for the user, and an IP range based upon the tracert done from the software. This range (since its dialup its not a specific ip) limits the box the feed can come from . From there the user is emailed a server config file, along with an instruction manual on how to start the encoder and what directory to put the server config file. Then away they go!

If it's on demand, and they send encoded file, same thing happens. They encode the file and the destination is? our server. One difference is that we will set a disk quota based upon the number of hours and bit rate purchased. So if the user bought up to 4 hours of encoded 28.8 video, they get 25kbsx60x4 or 6mbs of disk storage.

The user is then sent complete instructions on how to link to the file. Or we can just license the RealNetworks publisher which has this built in.

Green Day's Armstrong upbeat in lively SXSW show

AUSTIN, Texas (AP) ? Green Day isn't talking about the recent rocky past, but they're playing like the old days.

An upbeat Billie Joe Armstrong whipped the Grammy-winning punk trio through an ear-splitting two-hour show Friday night at the South by Southwest Music Festival, returning to the stage for only the second time since Armstrong emerged from a rehab stint that caused the band to postpone an arena tour.

The 41-year-old Armstrong made no mention of his problems with substance abuse while playfully bantering with a nearly sold-out crowd Moody Theater and ripping through a 25-song marathon. The energetic set mixed new rockers from the "Uno!" ''Dos!" ''Tre!" trilogy the band rolled out last winter and old favorites like "Longview" and "American Idiot."

"This ain't no (expletive) cafe!" Armstrong told the crowd right out of the gate. "Get crazy!"

Armstrong's good spirits were a sharp contrast to his profane meltdown at the iHeartRadio Music Festival in Las Vegas in September, when he complained the band's time was being cut short and smashed his guitar. Two days later, Green Day announced Armstrong was headed to treatment for substance abuse.

His cheery chatting with the audience at the showcase SXSW gig did include one moment when, while apparently encountering a hiccup with his microphone, Armstrong quipped, "I wasn't even on drugs," while laughing.

Green Day is among the marquee acts at SXSW this year along with Justin Timberlake, Dave Grohl and the Yeah Yeah Yeahs. The weeklong festival turns out the lights Saturday when Prince is scheduled to play an intimate finale for just a few hundred guests at a small Austin club.

Green Day didn't just swing into Texas for a warm-up show before their delayed tour finally begins March 28 in Chicago. The band also walked a red carpet earlier Friday for the premiere of the documentary "Broadway Idiot," which chronicles Green Day turning their 2004 career-reviving album "American Idiot" into a musical.

Private jet from Oklahoma crashes in Indiana neighborhood

SOUTH BEND, Ind. (AP) ? A private jet apparently experiencing mechanical trouble crashed Sunday in a northern Indiana neighborhood, leaving multiple people dead after it hit three homes, becoming lodged in one of them, authorities and witnesses said.

The Beechcraft Premier I twin-jet had left Tulsa, Okla.'s Riverside Airport and crashed near South Bend Regional Airport, Federal Aviation Administration spokesman Roland Herwig in Oklahoma City said.

"Fatalities have been confirmed at the scene," said Deputy St. Joseph County Coroner Michael O'Connell. He would not say how many people are dead.

The plane is registered to 7700 Enterprises of Montana LLC in Helena, Mont. The company is owned by Wes Caves and does business as DigiCut Systems in Tulsa, Okla. It makes window film and paint overlay for automobiles. Herwig said he did not know how many people were aboard the jet.

A woman identifying herself as Caves' wife answered the phone at their home Sunday and said, "I think he's dead," before hanging up.

In South Bend, Assistant Fire Chief John Corthier said some people who were injured had been taken to the hospital, but he did not know how many or what their medical conditions were.

The presence of jet fuel from the aircraft made the situation "very dangerous," Corthier said. The plane was lodged inside a house.

"It's still a rescue operation," Corthier said about three hours after the crash. Referring to one of the damaged houses, he said, "Because of the collapse in the house it's a very dangerous situation. We have to shore up the house before we can enter the house. "

Part of the neighborhood southwest of the airport was evacuated. Buses were transporting up to 200 people to a nearby shelter, Red Cross volunteer Jackie Lincoln said.

Mike Daigle, executive director of the St. Joseph County Airport Authority, said the jet attempted a landing, went back up and maneuvered south to try another landing, but eight minutes later the airport learned the plane was no longer airborne.

"There was an indication of a mechanical problem," Herwig said.

Stan Klaybor, who lives across the street from the crash scene, said the jet clipped the top of one house, heavily damaged a second, and finally came to rest against a third. Neighbors did not know if a woman living in the most heavily damaged house was home at the time, and a young boy in the third house did not appear to be seriously injured, Klaybor said.

"Her little boy was in the kitchen and he got nicked here," Klaybor said, pointing to his forehead.

His wife, Mary Jane, regularly watches planes approach the airport.

"I was looking out my picture window. The plane's coming, and I go, 'Wait a minute,' and then, boom," she said.

"This one was coming straight at my house. I went, 'Huh?' and then there was a big crash, and all the insulation went flying," she said.

(AP) ? Oh, is the Olympic year going to be fun.

Meryl Davis and Charlie White won their second world title on Saturday afternoon, adding even more spice to a rivalry with Tessa Virtue and Scott Moir that is already the best thing going in figure skating.

Not only did the five-time U.S. champions complete a perfect season, which included victories over the Canadians at the Grand Prix Final and Four Continents, they beat the Olympic champions in their hometown, where Virtue and Moir are, as the public address announcer said, "local skating icons."

"It's certainly special for us to be a part of, being able to go back and forth like we have since the last Olympics," White said. "Without them, I definitely wouldn't be to the point I'm at. Having such talented rivals as them at the rink every day and seeing how great they are has pushed us, and I'd like to think in return we've pushed them back.

"It's a lot of fun, and a great story line for next year."

And don't think this won't motivate Virtue and Moir, the reigning Olympic champions.

With 189.56 points, Davis and White beat Virtue and Moir by 4? points. That score also was a point higher than the world record the Americans had set at last season's Grand Prix Final.

"This rivalry between the two of us seems to have heated up now," Moir said. "It should be fun going into the Olympics."

It is the second world title in three seasons for Davis and White, whose victory in 2011 was the first by an American dance team.

"We try to celebrate these moments because we know there aren't an infinite amount of them," White said.

European champions Ekaterina Bobrova and Dmitri Soloviev of Russia won the bronze medal.

Madison Chock and Evan Bates were seventh in their worlds debut while Maia and Alex Shibutani were eighth. The United States will be able to send three dance teams to Sochi, the third straight Olympics the Americans have qualified the maximum spots.

The women's free skate is later Saturday.

Davis-White and Virtue-Moir have been trading titles since the Vancouver Olympics, where the Americans were runners-up. Either couple would dominate the sport if the other wasn't around.

But the fact they are has made both better, as anyone watching Saturday's free skate could see.

Unlike many couples, who trick up their programs with stunts and funky music and costumes, Davis and White let their dancing speak for them. Every second of their program was simply magnificent, so breathtaking you didn't dare blink for fear of missing something.

Pairs skaters ought to take note of their first spin, which was far better than anything done in the pairs competition.

It's a wonder Davis was able to stand up after their first lift. White flipped her up and around his back like a baton until she was in his arms, whirling feverishly the entire time.

And anyone who wants to learn how to skate should simply watch their programs. Their edge quality is better than that of any master craftsman, and there wasn't a spot on the rink that they didn't visit at least once during their program.

Most impressive? While most couples can only skate in one direction, Davis and White turn, travel and venture off in all kinds of different directions and patterns. Think walking and texting at the same time, and you get the idea.

When they finished, White knelt on the ice for several minutes, spent. But he had recovered by the time their marks were posted, jumping up to wave to the cheering fans.

"This has to be close to the top," White said. "Obviously, the first time we won worlds, being the first-ever American world championship, that has a special place. But our growth this season and how far we've come to win this gold medal, that's what makes this one really special."

Virtue and Moir grew up just outside of London, and the entire city seems to be on a first-name basis with them. The arena was filled with hundreds of their family and friends ? easily identifiable by their canary-yellow T-shirts ? and Canada's governor general was on hand to watch them.

No pressure there or anything.

"To have those people in the venue with us, it was special," Moir said. "Obviously there was a little bit of added pressure today. ... We wanted to go out and have a moment, like Charlie talked about. We all chase that."

Errors in their short dance left them trailing by 3.25 points, a sizeable gap by ice dance standards. But they weren't going to give up their title without a fight, especially not in front of all their fans.

Their "Carmen" was steamy and colorful, so much so you could practically see the blood pouring from her by the end of the program. They were always in time with the music and, as it grew, so did their movements.

The last 40 seconds of their program was downright frenetic, highlighted by their final lift sequence. Gymnasts would have been impressed with the backflip she did into his arms before he boosted her onto his shoulders and then spun her around.

Without even a second to catch their breaths, they immediately went into another lift, where she appeared to die in his arms.

"These are performances to build off of," Moir said. "We're looking forward to a big year next year and coming out on top."

To be continued.
